Terms of Service

1. Acceptance of Terms

By creating an account or using KegBase (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by Michael Main(“we,” “us,” or “our”).

2. Business Use Only

KegBase is intended exclusively for use by businesses, commercial breweries, and other commercial operations. It is not designed or intended for personal, household, or consumer use. By using the Service, you represent and warrant that you are: (a) acting in a commercial or business capacity; (b) not a “consumer” as defined under the Ontario Consumer Protection Act, 2002 or any similar legislation; and (c) entering into these Terms as a commercial agreement between businesses. If you are an individual using the Service for personal or non-commercial purposes, you are not authorized to use the Service.

3. Description of Service

KegBase is a cloud-based keg tracking and management platform designed for breweries. It allows users to track keg inventory, log keg movements to and from accounts, manage accounts and contacts, and view movement history. Features vary by subscription tier.

5. Account Registration

You must provide accurate, complete, and current information when creating an account. You are solely responsible for all data you enter into the Service, including keg records, account details, and movement logs. We are not responsible for errors, losses, or consequences resulting from inaccurate or incomplete data entered by you or anyone acting on your behalf. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@kegbase.ca if you suspect unauthorized access. You must be at least 18 years old to use the Service.

6. Subscription Plans and Payment

KegBase offers the following plans:

  • Free — no charge; subject to feature and usage limits
  • Professional — $34.00 CAD/month or $340.00 CAD/year

Paid plans are billed in advance through Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis. All prices are in Canadian dollars and are subject to applicable taxes. We reserve the right to change pricing with reasonable notice. Payment processing is handled by Stripe — we do not store your full payment card information.

7. Free Trial

We may offer a free trial for paid plans. Free trials are available once per account and per payment method. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel beforehand. If you cancel during the trial, your account will revert to the Free plan.

8. Cancellation and Refunds

You may cancel your subscription at any time through the billing portal in your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are issued for partial months or unused portions of a billing period. If you believe you have been charged in error, contact us at support@kegbase.ca within 30 days.

9. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service or its infrastructure; (c) scrape, copy, or redistribute the Service's code or data without permission; (d) upload or transmit malicious code; (e) use the Service in any way that could damage, disable, or impair it; or (f) resell or sublicense access to the Service without our written consent.

10. Your Data and User Responsibility

You retain ownership of all data you enter into KegBase (“Your Data”). You are solely responsible for the accuracy, completeness, and legality of Your Data. We are not liable for any losses — including lost inventory, financial losses, or business disruption — arising from data you entered incorrectly, data you failed to enter, or decisions you made based on information displayed in the Service. You should maintain your own independent records for any data you consider business-critical. We do not sell Your Data to third parties.

11. Third-Party Services

KegBase is built on and depends upon third-party infrastructure providers, including but not limited to Supabase (database and authentication), Vercel (hosting and deployment), Stripe (payment processing), and Cloudflare (network security and performance). We are not responsible for any outages, data loss, errors, security incidents, or service interruptions caused by these or any other third-party providers. Each provider operates under its own terms of service and privacy policy, which govern their services independently of KegBase. Your use of KegBase constitutes acknowledgment that the availability and performance of the Service depends in part on these third parties and that we cannot guarantee uninterrupted service as a result.

12. Intellectual Property

The KegBase name, logo, software, design, and all related materials are the exclusive property of Michael Main and are protected by applicable intellectual property laws. These Terms do not grant you any rights in our intellectual property beyond the limited right to use the Service as described herein.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY DATA STORED IN THE SERVICE WILL BE PRESERVED OR ACCURATE; (C) THE SERVICE WILL MEET YOUR SPECIFIC BUSINESS REQUIREMENTS; OR (D) ANY DEFECTS WILL BE CORRECTED. WE EXPRESSLY DISCLAIM ALL LIABILITY FOR ANY FAILURES ATTRIBUTABLE TO THIRD-PARTY SERVICES INCLUDING SUPABASE, VERCEL, STRIPE, AND CLOUDFLARE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Michael Main SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF INVENTORY, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS LIMITATION APPLIES TO ALL CLAIMS ARISING UNDER THESE TERMS OR RELATED TO THE SERVICE, INCLUDING CLAIMS ARISING FROM: (A) USER ERROR OR MISUSE OF THE SERVICE; (B) OUTAGES OR FAILURES OF THIRD-PARTY PROVIDERS INCLUDING SUPABASE, VERCEL, STRIPE, OR CLOUDFLARE; (C) DATA LOSS OR CORRUPTION; (D) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR (E) ANY OTHER CAUSE BEYOND OUR REASONABLE CONTROL.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL FEES ACTUALLY PAID BY YOU TO US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

15. Indemnification

You agree to indemnify, defend, and hold harmless Michael Main from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use or misuse of the Service; (b) Your Data; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, internet or infrastructure outages, outages of third-party services (including Supabase, Vercel, Stripe, or Cloudflare), cyberattacks, government actions, or any other event outside our control.

17. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. You may terminate your account at any time by contacting us at support@kegbase.ca. Upon termination, your right to use the Service ceases immediately. Sections 10, 13, 14, 15, and 18 survive termination.

18. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
